Offit Kurman Telebriefs: New DOL Salary Threshold, Minimum Wage Increases in NJ and MD, and More

On January 1st, 2020, the Department of Labor’s new salary exemption test took effect. The rule increases the salary required to meet the exemption test to $684 per week, or the equivalent of approximately $36,000 per year. Employers who have classified exempt employees as executives, professionals, or other administratively exempt employees must ensure that those individuals’ salaries exceed the new requirements. Otherwise, the employees will need to be converted into nonexempt status or have their salaries raised.

The start of the new year also saw several states raise their minimum wages. Maryland’s minimum wage has increased from $10.10 per hour to $11 per hour. In New Jersey, it increased from $10 per hour to $11 per hour.

Additionally, effective January 1st, the US Department of Transportation’s Federal Motor Carrier Safety Administration announced a new minimum annual percentage rate for random drug testing. An employer must now conduct tests equivalent to at least 50% of the organization’s average number of driver positions.
