Friday Factoid: Increased Criticism for YouTube

Under the Digital Millennium Copyright Act of 1998 (“DMCA”), websites like YouTube are exempt from copyright infringement liability if they merely provide a platform to host third-party material and follow the DMCA’s procedures for taking down infringing content. Many in the music industry are demanding that the DMCA be changed to require sites like YouTube to pay greater royalties on the videos they make available. A March 2016 report from the music industry claims that the amount of money sites like YouTube have paid in royalties to U.S. record labels is less than the amount of total sales for vinyl records.
